❖ using, indexing, retrieving, processing or incorporating any Content in connection with any AI-powered search engine, answer engine, conversational search service, generative search service, AI assistant, chatbot or similar system where the purpose or effect is to generate, summarize, synthesize, reproduce, answer from, or otherwise provide users with information or content derived from or based upon the Content, except as specifically and explicitly authorized by CME;
❖ removing, disabling, circumventing, damaging or otherwise interfering with any features of this website or otherwise which are intended to limit, restrict or prevent any particular form of access to, use, copying, reproduction, extraction and/or collection of any Content (or portion thereof) in connection with any AI Uses; and
❖ assisting, enabling, facilitating, directing, encouraging, permitting or knowingly allowing any third party to engage in any of the foregoing activities.
For purposes of these AI Usage Terms, “AI Uses” means any use of Content, in whole or in part, in connection with the development, pre-training, training, fine-tuning, adaptation, testing, evaluation, benchmarking, validation, operation, improvement, commercialization or other use of any artificial intelligence, machine learning or automated computational system, model, tool, application or service, including but not limited to Generative AI, LLMs, foundation models, multimodal models, computer vision systems, natural language processing systems, speech and voice systems, music and audio generation systems, image and video generation systems, synthetic media systems, GANs, diffusion models, RAG systems, embeddings, vector-based systems, synthetic-data systems, AI-powered search or answer systems, conversational AI systems, AI assistants, chatbots and any present or future successor, derivative or substantially similar technology.
2. Text and Data Mining Reservation
For the avoidance of doubt, CME expressly reserves and, to the fullest extent permitted by applicable law, opts out of any rights of third parties to conduct text and data mining under any and all applicable international and local laws, including but not limited to the European Union’s DSM Directive (2019/790/EU), together with local implementations and related legislation, to the fullest extent permitted (or not otherwise restricted) under such laws.
CME reserves all its rights in and to the Content in connection with all related matters, including rights relating to copyright, related rights, database rights, trademarks, publicity and personality rights, performers’ rights, moral rights, contractual rights and any other rights available under applicable law.
This reservation supplements and is without prejudice to CME’s rights under Article 7(2) of the European Union’s DSM Directive (2019/790/EU) and its implementing or related legislation in all EEA member states.
3. Search Engine Exception
Notwithstanding the above, nothing in these AI Usage Terms is intended to prohibit or restrict any automated processing, including indexing and crawling, of Content by search engines for the sole purpose of displaying Content in search results and determining search rankings, provided that such activity does not involve the use of Content for AI training, model development, dataset creation, Generative AI purposes, AI-generated outputs, AI-powered search or answer generation, or any other AI Uses prohibited under these terms.
4. No Implied Authorization
The availability, accessibility or visibility of any Content through CME’s websites, applications, platforms, online stores or other services does not constitute or imply permission, authorization, license, consent or other right to use such Content for any AI Uses.
Any permission, authorization or license for AI Uses must be expressly granted in writing by CME and, where applicable, by the relevant copyright owner, artist, performer, creator, rights holder or other authorized party.
5. Future Technologies
These AI Usage Terms apply regardless of the name, classification, architecture, technical implementation or method of operation of any artificial intelligence, machine learning or automated computational technology.
The specific technologies, systems, applications and examples identified in these terms are illustrative and are not intended to limit the scope of “AI Uses.” The absence of any particular technology, system, method or application from these terms shall not be interpreted as permission to use Content in connection with that technology, system, method or application.
CME expressly reserves the right to update, supplement or modify these AI Usage Terms as artificial intelligence technologies, applicable laws and industry practices develop.
6. Conflict With Other Terms
In the event of any conflict between these AI Usage Terms and any other terms and conditions governing your access to and use of CME’s websites and mobile applications, these AI Usage Terms shall prevail with respect to matters concerning artificial intelligence, machine learning, automated processing, text and data mining and related uses of the Content.
